ALTA SIERRA ARBITRATION RESULTS REBUTTAL BY RESIDENT

The recent e-mail that the ASPOA board sent regarding the outcome of the lawsuit against the ASPOA needs clarification. We have been asked by many to distribute the actual arbitration decision. First and foremost of importance, which was not mentioned by the board in their email, was the determination that the ASPOA had no legal basis to try to convert Alta Sierra into a mandatory HOA with mandatory dues in order to enforce the Deed Restrictions on your property. This ruling has been recorded and will serve as a guarantee that neither this board nor any board in the future can attempt such an effort. This was the basis of the lawsuit against the ASPOA and our opposition to the board's actions and expenditure of legal fees from the treasury. The ruling was a success for the lawsuit.

Second, as per the lawsuit, it was determined that the ASPOA has no authority to enforce our deed restrictions. There are 21 subdivisions and each one has it's own separate restrictions. The importance and repercussions of this ruling is evident by the arbitrator's decision that the board cannot be sued for past actions against homeowners who they attempted to exercise authority over. However, in moving forward, if the ASPOA attempts to usurp their authority to enforce the deed restrictions, they are open to a lawsuit...with a ruling that has already been decided and recorded. The duties of the Architectural Review Committee (ARC), which again are not all the same in each of the 21 subdivisions, does have authority over matters such as: new home construction, fence building, mailboxes and tree cutting. Because the ARC has allowed just about everything in the past, they cannot now arbitrarily pick and choose what they deem acceptable. Further, new home construction and new additions are covered by county regulations. The rules pertaining to fire prevention and trees are defined by fire safety regulations, which trump the ASPOA. The ASPOA has never had authority to fine anyone and because of this, the board, through legal means, attempted to pursue the mandatory HOA/Davis Stirling Act, which would have allowed it.

What this ruling means is that approx. $25,000 in legal fees was completely wasted from the treasury from 2012 and 2013 in attempting to enforce the deed restrictions that the board had no power to do, and to pursue a mandatory HOA, for which Alta Sierra could never have qualified under the Davis Stirling Act.

The arbitrator's ruling chastises the board for breaking their own By Laws by not providing the updated membership list so that the Recall could properly notice all members. Yet the recall was ruled invalid because the Recall was unable to properly notice all members. In order to accomplish that, the Recall would have had to file another lawsuit, gone to court to have a judge force the board to comply with their own By Laws. Unfortunately, there were not unlimited funds for legal fees nor was there a treasury from which to draw funds. The members were noticed in every way possible under the circumstances, and we had competent and experienced legal advice. However, the arbitrator ruled that because we had the option to file another lawsuit, the recall vote was invalid. Whether you support the board's actions or oppose them, it is your right to voice your opinion and receive accurate facts. The ASPOA is a voluntary membership organization of far less than half of the residences and it does not speak for Alta Sierra as a whole, and cannot by law, be involved in political issues.

We are all neighbors and regardless of our opinions, we can treat each other with respect. We can agree that we want the best for our community, even as we may see that road differently. These court decisions have succeeded in putting important issues to rest. Thank you for your involvement in this process.

I was asked to mention: Some residents are exploring the idea of having another voluntary neighborhood organization/club as an alternative choice to the ASPOA that could also provide the propane discount and offer new benefits to the community separate and apart from the beneficial, established ASPOA programs. Two organizations could provide choices in member dues and provide more benefits, especially if the two agreed to work together. Your thoughts and ideas are welcome by replying to this email.

Arbitrator Simon delivered his arbitration award to the parties in the late afternoon of December 1st, ruling the following:

· The October 19th recall vote of the ASPOA Board to remove 8 of the 9 Directors was not a valid action as it was not properly noticed.

· The subsequent November 2nd recall election of 8 replacement Directors was not a valid action as the recall action was not ruled valid.

· ASPOA has the legal authority and responsibility to enforce the Deed Restrictions relating to those matters within the purview of the original Architectural Committee (fences, trees, building plans, setbacks, temporary dwellings, etc.) for each subdivision in Alta Sierra. Alta Sierrans, themselves, may seek to enforce DR violations within their own subdivision (easements, signs, pets, appearance of yards, etc.).

The delivery of a binding ruling by Arbitrator Simon should bring us all relief from the conflict that has plagued our community for months, and gives our association the opportunity for a fresh start. We have all agreed upon the importance of resolving disagreements with respect and a civil dialogue. Let’s put aside our differences and all work together for the benefit of our membership as agreed upon in the mediation settlement. Instead of resorting to recalls, lawsuits, and inflammatory newspaper articles, let’s use the agreed upon concept of a conflict resolution committee to receive, review, and decide issues where there is disagreement. And let’s call upon the members to provide input for program priorities and large expenditures by the Association.

Another notable achievement is the completion of the official ASPOA election held on Monday, Dec. 2nd. We tallied an amazing 496 ballots submitted by members, who made their voices heard in this balloted election. The top three candidates who received the highest number of votes were elected to the ASPOA Board. Results are as follows:

BEAR RIVER LITTLE LEAGUE - SIGN UP TIME


With the holiday season upon us and the longing for spring days that lie ahead, it’s time to register for Bear River Little League. The 2013 season was another enjoyable experience for the more than 250 local boys and girls that participated and the 2014 season promises to be even better.


The Bear River Little League Board is extremely grateful for the efforts of all parents and volunteers and appreciates all the hard work they put in on behalf of the children and our community. Whether through coaching, cheering as a parent in the stands, umpiring, or working the snack shack, your efforts are valued greatly. ALTA SIERRA PROPERTY OWNERS ASSOCIATION CALLING FOR VOTES



Dear ASPOA Member,

By now, you should have received your official ballot for the upcoming ASPOA Director Election. We encourage you to get informed about your candidates by visiting the only official ASPOA website: www.aspoa.org. On this site, you will see full profiles of all five candidates who are running for the three vacancies on the ASPOA Board of Directors.

Mailed ballots must be received no later than November 29th, at the special PO Box rented for this election. That address is: ASPOA, P.O. Box 2749, Grass Valley, CA 95945-2749. Ballots received after that date will not be counted. Because this is the week of Thanksgiving, please mail your ballot no later than this Tuesday for guaranteed delivery.

Ballots may also be returned in person on Monday, December 2nd, between 9:00 and 10:00 a.m., at the Alta Sierra Country Club located at: 11897 Tammy Way, in Alta Sierra.

Please be sure your completed ballot is sealed inside your personal return envelope with the watermarked return label. Ballots with opened or missing return envelopes may not be counted, if they appear to have been tampered with.

HOW DO PEOPLE WALK ON FIRE?

It is true that the temperature of the coals is over 1000 degrees F (535 degrees C), and that human flesh burns at much lower temperatures, but temperature isn't the only part of the relevant physics. Different substances have different heat capacities. Water is the standard. Our feet are mostly water. The coals have a much lower heat capacity than water. That means that the same 
amount of energy flowing away from the coals will lower their temperature much more than that same energy flowing to the feet will raise the foot's temperature. If the foot stays in contact with the coals, energy will keep flowing until they both reach the same temperature. However, this takes time, and how much depends on the heat conductivity. There are good heat conductors, like water, and poor conductors/heat insulators, such as ash. The feet cool down the local area of the coals they touch, and it takes time for energy to flow from the rest of the fire to the cool spot. You can sometimes see dull orange footprints in the coals right after someone walks. Water is a good heat conductor and energy transferred to the foot is rapidly conducted away from the contact points so the temperature doesn't rise to the burning point. Temperature, heat capacity, and thermal conductivity are all important in this demonstration.

A more familiar experience which involves the same physics is baking brownies in the oven set to 450 degrees F. Everything in the oven is 450 degrees, but you don't fear putting your hand in the oven air. The air has a very low heat capacity meaning it stores very little thermal energy. Air is also a heat insulator. Your hand (mostly water) cools the air locally and heats up very little. If you stick your finger in the brownie, you might get burned. It is mostly water like your hand and has a pretty good heat conductivity. Thermal energy will flow to your finger raising its temperature quickly. The metal pan is another matter. It has a high heat capacity and a high conductivity. Touch it without a potholder and you might instantly burn your fingers.

What the physics tells you, is that if you walk fast and don't stay in contact with the coals very long, you won't get badly burned.

RATTLERS - 7TH GRADE VOLLEYBALL


Magnolia's 7th grade boys volleyball team continue in their winning ways over the weekend but fell short of their goal as they lost in 3 sets to Lymon Gilmore which was good for a second place finish at the 23rd annual Gilmore Tournament

Magnolia has defeated Pleasant Valley, Union Hill and 7Hills in the first round of regular season play. Noah Skaronski, John Pallinger, Daniel Tandem, Ethan Warner and Logan Jenkins have had stand out performances for the team.

ASPOA - SETTLEMENT ACHIEVED - MEDIATION

Settlement Achieved

We have some good news for Alta Sierrans. Realizing that a prolonged legal battle was not good for the Alta Sierra community or any party to the conflict, we entered into a mediation to investigate an end to the prolonged conflict. On November 6th the case of ASN vs. ASPOA, Inc. was mediated under the apt guidance of retired Judge Albert Dover and an agreement was achieved. There were several issues that both sides rapidly agreed would benefit the membership. These solutions look to the present and future wellbeing of our community and are listed in the Memorandum of Agreement (MOU) and summarized below:

 Both sides value the importance of resolving disagreements with respect and civil dialogue. We recognize that we may reasonably disagree with one another and agree to avoid disparaging remarks toward each other. We are neighbors in a great community!

 The BOD will implement a Conflict Resolution Committee to receive, review, and decide issues presented to it by any member of ASPOA or any lot owner of Alta Sierra. The Committee will develop and use a fair, efficient, and reliable process for the resolution of conflicts so that members do not have to resort to more costly methods of resolving disputes.

 The BOD will survey members before undertaking “large” expenditures to provide members a voice in the financial control of ASPOA.

 The BOD will establish an “election protocol”, beginning in 2014 to ensure elections reflect the value of civility, honesty, integrity, and the need to use dialog as a way of exploring disagreements over direction for the association.

 The BOD will take periodic polls of the membership to ensure it is connected with the priorities of the membership.

Additionally, the lawsuit filed by the Alta Sierra Neighbors, as well as the counter- suit filed by ASPOA will both be dismissed.

There were two areas in dispute resolved during the mediation session by both of the parties agreeing to submit to binding arbitration for resolution before the end of November: First, the validity of the recall elections and, second, the authority of ASPOA to enforce Declarations of Restrictions for the Alta Sierra subdivisions.

With regards to the elections issue, there are three possible outcomes under arbitration:
1. The recall was invalid which will also nullify the election on November 2nd. In this event, the current Board remains and the December 2nd election for 3 board seats will happen as scheduled.

2. The recall was valid but the November 2nd election was not. All 8 recalled Directors would be removed from the BOD, and are unable to run in a valid election to replace them, to be scheduled as soon as permitted under the bylaws.

3. Both the recall and the November 2nd election are valid. Those candidates elected on November 2nd will immediately assume their eight seats as new members of the BOD and the scheduled December election will be cancelled.

The other conflict to be settled through arbitration is whether ASPOA has authority to enforce Declaration of Restrictions (DR) in the subdivisions of Alta Sierra. Both sides agree that authority to enforce the DRs was initially given to an Architectural Committee governing the DRs in the various sections of Alta Sierra. The conflict arises over whether this authority was appropriately shifted to ASPOA and the Architectural Review Committee that exists under the ASPOA umbrella. If the Ruling is that authority was shifted to ASPOA, then this Ruling, or abstracts of it, may be recorded against the 21 subdivisions making up the Alta Sierra Estates.

While we await the Rulings above referenced as regards the election, the “original board” will continue to conduct the affairs of the Board. However, no expenditures other than normal business shall be made. The estimated time frame for the arbitrator to determine the resolution to the above issues is on or prior to November 29th, 2013.

We are hopeful that the end of these conflicts will lay to rest the issues that have divided us, put our community back on the path towards peace, and that our agreements will enhance our ability to resolve any future differences in the fairest, most efficient manner possible.

BROWN SOX 12U HOSTING WOOD BAT TOURNAMENT


On Sunday the Brown Sox 12u baseball team will be hosting its first annual wood bat tournament at Western Gateway Park in Penn Valley. The first two games (8 am) will pit the Brown Sox Gold team versus the Lincoln Outlaws on field #1 while the Brown Sox Brown team will play the Rocklin Pilots.

The winners of the first two games will play each other while the teams that lose will also play. This is a double elimination tournament.

The Brown Sox 12u team is made up of players from 6 different Little Leagues. It has been interesting to watch the boys grow as players as well as teammates.

ASPOA - MEET YOUR CANIDATES - NOV. 9, 2013

BROWNING (FOLSOM HIGH) VERSUS WILSON (COLFAX HIGH)


I will not attempt to show Michael Wilson of Colfax as a better passer than Jake Browning of Folsom but I will note that Wilson is having a great year in his own right. Wilson is a senior while Browning is a junior. Look out Sierra Foothill League teams as you will have to play against what I will call the 2013 National Player of the year in his final high school season. 

Below are a series of charts which compare Wilson and Browning head to head.

Yards per game, only in week two did the Colfax senior have more yards than Browning.

Browning has 49 touch downs on the season which is off is 2012 total of 69. Also in 2012 Browning threw for 5,238 yards. That is what Wilson has done in two seasons.



The ever so popular QB rating is also in favor of the Bulldog's signal caller.

Michael Wilson is a very skilled D-4 high school quarterback and very well may play in the college ranks in 2014 but one thing is for sure for Browning he will be playing at Folsom High next season. BEAR RIVER LITTLE LEAGUE FUNDRAISER


    Bear River Little League is asking for a little help on Sunday, November 17, 2013 from 1:00pm until 4:00pm
    at 10286 Braemar Way, GV 95949. They will be holding a Holiday Open House fundraiser where vendors will be lending support to our local Bear River Little League. A few of the companies who will be in attendance are Mary Kay, Thirty-one Gifts, Tupperware, gold canyon candles, Jamberry, Silpada, Pamper Chef, + more.

    Its not too early to do some Christmas shopping while helping the Little League.

    BEAR RIVER CROSS COUNTRY - ALL LEAGUE - NEXT UP SUBSECTIONS


    The Bear River cross country team's two top ten finishers, Sierra Mitchell (2nd) and Viviana Chavez (5th) earned All-PVL honors.

    The cross country team raced in Lincoln this past Wednesday. In the Varsity Girls race, Sierra Mitchell was the first Bruin to cross the finish line in 2nd place with a time of 20:23 for the 3 mile course. She was followed by Viviana Chavez in 5th, Jessica Meylor in 11th, Cecilia Malik in 18th and Olivia Kirks in 34th, Taylor Autrey in 38th, Olivia Scinto in 44th and Amanda Beardsley in 52nd. 

     Lauren Wegner took 8th in the 2 mile Frosh/Soph Girls race. On the boys side, Brandon Murphy placed 14th in the Varsity Boys 3 mile race. Racing Frosh/Soph Boys was Patrick Gillis in 5th and Justin Dooley in 10th. Overall the Varsity Girls were 2nd place in the PVL.
    The team will race at Subsections in Angels Camp November 9th. (Mitchell)

    ASPOA ELECTION - BOARD CLARIFIES CONFUSION

    Dear Alta Sierra Resident,

    The ASPOA Board has received many inquiries regarding confusion over the two upcoming elections. We hope to clarify the issue for you.

    The official ASPOA election takes place on December 2nd, and ballots for that election will be mailed to members. There are a total of six candidates presented to fill 3 open director positions. There has not been a balloted election for many years; due to increased interest and participation this year, there are more candidates than vacant positions.

    Here are the important official election dates for you to remember:

    Tomorrow’s (11/2) election sponsored by RecallASPOA, with 11 candidates on the slate, is unsanctioned by ASPOA and any results will not be valid unless a court order is issued in their favor. They are attempting to fill 8 board positions they believe were vacated with their recall efforts, despite the lack of a ruling in their favor by a judge. The hearing to resolve this matter has been postponed until November 21st, though we cannot be certain there will be a decision made until after the official election.

    NEVADA UNION BASKETBALL TRYOUTS

    Nevada Union High School's boys and girls basketball tryouts begin Monday November 11. 


    The Miner's head coach Jeff Dellis will look to improve on last season's 9-18 overall record. This will be no easy task as NU lost their top scorer and re-bounder 6-foot-8 Lukas Vojack (15.3 points and 8.8 rebounds per game) who moved out of the area as well as graduating Cody Gardner (10.8 ppg). Dellis will build the 2013-14 team around returning shooting guard Nolan Stefani (5-foot-10) who averaged 8.4 points per game. Anytime you lose your top two players including a post player the following season can be very difficult. The 2012/13 JV team went 12-15 overall with a 1-9 Sierra Foothill League record. 

    The boys team will play their first game on Dec. 2 at Eldorado and their first home contest will be Jan. 10 when they tip-off against Woodcreek.


    While the boys may continue to struggle this season the girls team looks as if they should continue their winning ways. NU coach John McDaniel led his Lady Miner team to a 21-5 overall record and went 9-1 in the SFL. McDaniel's team did graduate a few very talented players, but they are still very strong. They do return Sydney Porter (13 ppg) who was their leading scorer, 5-foot-11 Sammy DeHart (8 ppg) the team's 3rd leading scorer, Emma Peterson (7.3 ppg) their 4th leading scorer. 

    The Lady Miners look as if this will be a reload year. Their first game is scheduled for Nov. 29 at Christian Brothers and their first home game is Dec. 3 versus Vanden.

    BEAR RIVER - NEVADA UNION - JUNIOR FOOTBALL PLAYOFFS


    As both Nevada Union High School's and Bear River High School's varsity football teams continue to struggle this fall, the future looks bright for the two local schools as three of the Bear River Junior Bruin and two Nevada Union Junior Miner's football teams won their first round playoff games.

    2013 SVUSA Playoff Game Schedule 2nd Round Playoff - November 2nd, 2013 

    Host: Del Campo Jr. Cougars 
    Del Campo High School - From I-80: Take the Madison Avenue exit. Go east to Dewey Drive and turn right (south). School is on your right. 

    The Bear River Junior PeeWee team who enters game as the 5 seed will play in the 9 a.m. game. They will take on top seeded Capitol Christian.

    The Bear River Junior Midget team will play Del Campo in the 1 p.m. game who enter their second round game as the #3 and #2 seeds respectively.

    Nevada Union's Midget team will play in the last game of the day (3 pm) where they will take on Del Campo. The Junior Miner's team enters the game as the #2 seed where the Junior Cougars are the #3.

    Host: Lincoln Jr. Zebras 
    Lincoln High School - From I-80 west; Go East to Highway 65 exit to Lincoln. Once in Lincoln, turn left (west) on 7th Street. At J Street, turn right (north). 

    The Junior Miner's Junior PeeWee team kicks off at 10 am for a contest against Lincoln. The Miners earned the #2 seed while the Zebras are the #3 seed.

    Nevada County's top seeded team is the Bear River Midgets who only dropped one game this season. The Bruins will take on Placer at 4 pm. The Bruins are the #1 seed while the Hillman are the #4.

    BROWN SOX 12U FALL IN CHAMPIONSHIP


    The Brown Sox 12u baseball team took to the field at Redwood Park in Sacramento for a two day tournament on October 26 and 27th. They made it to the championship game with a 4-3 win on Sunday over the River City Outlaws where Bennett King picked up the win while Ryan Bradford got the save. The Sox's bats when quite as they fell in the championship game to Sacramento Baseball Organization under windy and cold conditions. Dustin Thompson scored the Sox only run in the championship game which can on an RBI single by Dean Hopper in the top of the first inning.

    On day one of the tournament the Sox dropped the Outlaws 10-2 and Best Speed Baseball by a score of 12-5. Which was good enough for the tournaments #1 seed going into championship Sunday.

    Tucker Ramos went 6 for 6 with two doubles and Trevor Nielsen went 4 for 4 while Hopper went 4 for 6 with two doubles and triple and a home run on Saturday.

    The Brown Sox carry an overall record of 18-5 for the fall season.

    The Sox will host the Lincoln Tribe on Sunday at Western Gateway Park.

    To all ASPOA members:
    The election vote for 8 new successor board members is scheduled for Saturday, Nov 2, 10 AM at the Alta Sierra Country Club.
    There are 11 ASPOA members that are running for these vacated seats. We have 4 former ASPOA board members with prior experience who have served in years past, as well as members who have experience being on other boards, and others who are professionals with skills that can well serve the community. Please take a few minutes to learn who these candidates are. You can also access the candidate profiles by clicking on this link: www.ASPOABoardCandidates.COM. This is an exciting election where the membership will finally have the opportunity to select the board of our choice.
    Attached is the ballot/proxy. If you are not planning to attend the election meeting, please use the attached ballot to vote for a maximum of 8 candidates, fill in the name of a proxy to cast your vote for you, and e-mail it, fax it, or send it to:
