The ASPOA board sends the following email after the Recall Group claims victory....
Dear ASPOA Member,
You
may have seen the signs posted by Recallaspoa claiming the ASPOA Board
has been recalled. We have received many phone calls and emails asking
what these signs mean, and the answer is: NOTHING, unless Judge Anderson rules in Recallaspoa’s favor at the scheduled hearing on November 7th.
We
strongly believe that neither the results from the meeting last
Saturday, nor the results from the unofficial election in November, will
be considered valid by the judge. The significant number of Bylaw
violations by Recallaspoa have culminated in the scheduling of an
unofficial vote and election. If permitted, we feel these actions
violate our Members’ rights to a fair election as provided for in the
Bylaws.
The poor turnout of about 60 people
(many of whom were couples, with one vote between them) on Saturday
seems to indicate the majority of Members do NOT support the recall. The
Board remained outside of the meeting, and provided additional
information to attendees.
We are continuing with the scheduled, official ASPOA director election on Monday, December 2nd.
If you would like to volunteer to count official ballots, please
contact Julie Siegenthaler, Nomination Committee Chairperson at: j.siegenthaler@att.net.
We would like to remind you that all director nominations must be received by this Friday, October 25th. Please
mail completed forms to: ASPOA, P.O. Box 2749, Grass Valley, CA
95945-2749 ASAP. Nomination forms are available in the October issue of
the Alta Sierran, and online (www.aspoa.org).
We
have been told by a number of members that the attorney representing
Kathy Monteiro in her lawsuit for dissolution of ASPOA has claimed he
does not represent RecallASPOA. We believe this to be disingenuous, as Mr.
Vodonick represents Kathy Monteiro who founded both RecallASPOA and the
Alta Sierra Neighbors. He is also the attorney who argued in court last
week, supporting the recall meeting.
Thank you again, for another outpouring of support via email. Please keep the encouragement coming, and please spread the word that ASPOA is alive and fighting on your behalf.
Sincerely,
The ASPOA Board of Directors:
Paul Hoefler, President
Lee French, Vice-President
Kathy Carey, Secretary
Jim Barilleaux, Treasurer
Gene Jovich, Director
Don Bessee, Director
John Keefe, Director
Julie Siegenthaler, Director
P.S. – Full copies of the lawsuit filed by Ms. Monteiro and our request for a Temporary Restraining Order are also online, if you are interested.
